Business terms of sale — Tout est Tendance modules

These terms apply to modules and associated services sold in the Tout est Tendance store. Custom web projects are governed by the specific terms provided with their quotation.

1. Seller and eligible customers

The seller is Caleb SENAT, French sole trader (entrepreneur individuel, EI), trading as Tout est Tendance, SIREN 509 745 634, SIRET 509 745 634 00022, 9 rue du Lieutenant Ohresser, 94130 Nogent-sur-Marne, France. Email: info@toutesttendance.com. Telephone: +33 7 81 80 22 92.

The catalogue is publicly accessible. Purchases are reserved for professionals acting for their business purposes, including sole traders and French microentrepreneurs. At launch, sales are limited to metropolitan France; French overseas departments, regions and collectivities (DROM/COM) and other countries are not open for sales.

Customers provide their business name, or professional identity as a sole trader, a SIREN or SIRET identifier and the business billing address. They confirm the professional purpose of the purchase and their authority to act for that business. The business’s existence is checked during ordering. An identifier or declaration does not replace the actual legal classification of the purchase or remove any mandatory protection that may apply.

2. Modules and requirements

The PrestaShop modules sold in this store are supplied by download without a physical medium. Each product page specifies its version, features, limitations, supported PrestaShop and PHP versions, any dependencies and documentation languages. These details apply to the selected module and do not automatically extend to other products. Before installation, customers prepare a restorable backup and check integration on a copy of their store.

3. Orders and business verification

Before confirming, customers can review and correct business details, order contents and the amount due, then accept these B2B terms and confirm their obligation to pay. Required business details, the professional-use declaration and verification form part of this process.

Once checks and payment are satisfied, purchase takes place directly without prior manual approval of the business account. The order confirmation and accepted terms are sent in a format the customer can retain.

4. Prices, payment and invoicing

The price of each module and, where offered, associated services or their renewal is shown in euros on the relevant product page and in the order summary before payment. The seller uses the French VAT exemption for the relevant French transactions: VAT not applicable under Article 293 B of the French General Tax Code. No 20% VAT is added for those sales. One product’s prices, compatibility and services do not define the terms of other products.

The applicable price and any offered discount are shown before confirmation. Full payment is due with the order, using the methods actually offered through PrestaShop Checkout Built With PayPal. No early-payment discount is offered. An invoice is provided after payment validation.

For any business amount remaining unpaid when due, late-payment interest is payable without a reminder from the following day. The rate is the applicable half-yearly European Central Bank refinancing rate plus 10 percentage points under the relevant French rules. The €40 fixed recovery charge applies per overdue invoice; additional recovery costs may be claimed with evidence when they exceed that amount, under the statutory conditions.

5. Downloads and licence

After confirmed payment, the purchased version’s file is made available through the process stated in the order confirmation. That file is kept separately from later releases; access does not end with commercial services. If the file is unavailable or a link is defective, customers contact the seller with their order reference.

The licence applicable to each module is identified on its product page and included with the downloaded file. These terms do not replace or reduce the rights granted by that licence. Expiry of commercial support or updates does not disable the installed module or end the right to use the purchased version.

6. Support and new releases

Each product page states whether the purchase includes commercial technical support and access to new releases, together with their duration, start date, scope and stated response time. These terms are available before ordering and recorded in the information retained for the purchased offer. Support is requested by email at info@toutesttendance.com. A response time is not a commitment to resolve every issue within that time.

Where renewal of services is offered, it is optional. The price and duration for the relevant module are presented before a separate order and payment. Renewal is handled manually by email. No automatic charge or renewal is set up. Access to the purchased file and use of the installed module continue after services expire.

The commercial service period does not reduce statutory guarantees and remedies applicable to business sales or the seller’s legal or contractual obligations. Exercising those rights does not depend on paying for renewal.

7. Guarantees, complaints and cancellation

Contractual conformity obligations and applicable statutory guarantees, including the latent-defect warranty under the conditions of the French Civil Code, remain. These terms do not impose a general exclusion of warranty or liability. Customers may report defects to info@toutesttendance.com with their order, version and useful diagnostic information, without waiving other evidence or remedies.

This offer is for genuine business purchases concluded online. It does not provide a general commercial right to cancel for convenience after supply. Mandatory rules applicable to the customer’s actual situation, remedies for non-performance and legally required refunds remain reserved. Business documentation does not waive such rights.

8. Data, disputes and retained terms

Business information, the declaration, orders, payments and support are handled under the store’s privacy notice. Only data necessary for verification and the business relationship should be used; verification sources and retention periods are described in that notice.

Customers may send complaints to the seller’s email or postal address above. Consumer mediation is not the applicable scheme for a genuine B2B relationship. French law applies subject to any mandatory rules; competent courts are determined under ordinary jurisdiction rules. These terms do not impose an exclusive commercial-court clause on all sole traders.

The accepted terms and order information are retained and provided to the customer in an accessible format.
